1. Acceptance of Terms

These Terms apply when you create an account or make a purchase; you agree to them at that point. Our Privacy Policy explains how we process your personal data. If you do not agree to these Terms, you cannot create an account or make a purchase.

Age Requirements: You must be at least 16 years old to use our Service. If you are between 16 and 18 years old, you confirm that you have obtained parental or guardian consent. Users under 16 must have a parent or guardian create and manage their account.

2. Service Description

ScoreUp Pro is an AI-powered educational platform designed to help users prepare for internationally recognised English and German language exams, including:

• IELTS Academic
• IELTS General Training
• Goethe-Zertifikat (A1–C2)
• telc Deutsch (A1–C1)

Our Service provides practice exams for Writing, Reading, and Listening skills, AI-powered grading and feedback, progress tracking, and daily practice streaks.

3. User Accounts and Responsibilities

Account Creation

To use certain features, you must create an account by providing a valid email address, secure password, and your name—or authenticate via Google OAuth or Sign in with Apple. You agree to provide accurate information and keep it current.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized access.

Personal, Non-Transferable Account: Your account is for your personal use only and cannot be transferred to anyone else; the same applies to everything you buy through it. You may not share access to your account with other people—anyone who wants to use ScoreUp Pro needs their own account.

Account Types

Individual Accounts: For personal use by individual learners.
Organization Accounts: For schools and teachers who manage student accounts. Organization holders must obtain necessary permissions and comply with educational privacy laws.

4. Payment Terms

Products and Prices

• Free Trial: 3 exam credits on signup that never expire
• Exam Credit Packages (no longer sold): Credits from the 10-, 30- or 60-credit packages bought earlier never expire and keep working
• Unlimited monthly plan (digital service): €19.99 per month. Introductory price: if your account has never had the Unlimited monthly plan, the first month costs €9.99; the subscription then renews at €19.99 per month. The introductory price cannot be combined with a discount code, except a creator code: its discount is then taken from the introductory price (for example €9.99 − 20% = €7.99). With any other discount code, if both apply, you pay the lower first-month price. The subscription renews automatically for another month each time until you cancel it. You can cancel at any time, effective at the end of the current billing month, via the “Cancel contracts here” link at the bottom of every page or in your profile. A subscription taken out through the App Store is managed and cancelled in the App Store; there, Apple decides under its own rules who receives the introductory price and charges the prices shown in the App Store in your local currency.
• Fair use of the Unlimited monthly plan: You can start up to 5 AI-graded Writing exams and, once Speaking exams are available, up to 5 Speaking exams per calendar day, counted in German time (Europe/Berlin). Only one exam can be open at a time: if you start a new exam while another one is still open, we warn you first; if you continue, the open exam is ended and can no longer be submitted.
• Organization Plans: For schools and teachers with multiple student seats

Payment Processing

Payments on our website are processed securely through Stripe; purchases in the iOS app (App Store) are processed by Apple. We do not store your complete credit card information.

Conclusion of the Contract

This is how the contract for the Unlimited monthly plan is concluded on our website: the plan shown on the pricing page is not yet a binding offer. You choose the plan, check its price, term and renewal in the cart, tick the box for the immediate start and continue with “Proceed to Payment” to the payment page of our payment provider Stripe. There you enter your payment details and make a binding offer by clicking the final button that confirms the paid subscription. The contract is concluded as soon as the payment succeeds and we activate your subscription. Until that last click you can check and correct your entries at any time: directly in the fields of the payment page, and your browser's back button takes you back to the cart; you can also cancel the process at any time. We do not store the contract text separately for you to retrieve. You can open, print and save these Terms at any time at scoreup.pro/terms, and after the purchase we email you the essential contract details and the withdrawal notice. The contract can be concluded in German, English, Turkish, Spanish, Russian, Arabic or French; the German version of these Terms is binding. Purchases in the iOS app are concluded through the App Store under Apple's terms.

Cancellation and Refunds

Exam credit packages bought earlier were one-time purchases, so there is nothing to cancel; their credits keep working. Your statutory right of withdrawal (Section 5) is unaffected. Apart from a withdrawal, we do not refund paid subscription months except where the law requires a refund (for example a duplicate charge, a service that does not work as described, or a justified extraordinary termination). You can cancel the Unlimited monthly plan at any time, effective at the end of the current billing month, via “Cancel contracts here” at the bottom of every page or in your profile; we confirm receipt of your cancellation by email straight away. You keep full access until the end of the month you have paid for and can undo the cancellation in your profile with “Resume subscription” until then; after that, the subscription does not renew. Apart from a withdrawal (Section 5), the current billing month is not refunded pro rata. Purchases made through the App Store are handled by Apple: Apple's terms apply to them, a subscription taken out there is cancelled in the App Store, and Apple decides on refunds for those purchases. Organization/school subscription plans can be cancelled anytime through account settings; access continues until the end of the current billing period.

5. Right of Withdrawal (Widerrufsbelehrung)

5.1 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

5.2 How to Withdraw

To exercise the right of withdrawal, you must inform us (Kadir Korkusuz, ScoreUp Pro, Friedrich-Dessauer-Straße 8, 60438 Frankfurt am Main, Germany, telephone: +49 157 83508553, email: contact@scoreup.pro) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at https://scoreup.pro/withdraw-contract. If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without undue delay, with information on the content of your declaration of withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

5.3 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

6. Referral Program

ScoreUp Pro offers a referral program that allows existing users to invite friends and earn rewards.

How It Works

• Referrers: Share your unique referral code with friends
• Referees: New users can enter a referral code when they sign up
• Rewards: If a referred friend makes their first payment within 30 days of signing up (on our website or in the App Store; for a subscription: the first paid month, even if discounted), the referrer earns 5 exam credits, which do not expire. If the referrer holds an active Unlimited monthly plan at that moment, the reward is instead a credit of €5 with our payment provider Stripe, which we credit to a later payment the referrer makes on our website; if we cannot credit it, the referrer receives the 5 exam credits instead. The credit is not paid out and cannot be transferred.
• Discount: A referred friend receives a referral discount only on their first purchase of an exam credit package on our website, and only while we sell these packages

Eligibility & Restrictions

• Only registered users with active accounts can participate
• Referral codes cannot be used for self-referrals
• A reward is granted only once per referred friend, for their first payment
• If the friend's first payment is refunded in full, or a subscription's first month is refunded after a withdrawal, the reward lapses; reward credits not yet used are removed again, credits already used are kept, and the unused part of a €5 credit is taken back
• Maximum 20 referral rewards can be earned per month per user
• Rewards are non-transferable and have no cash value

Fraud Prevention

We monitor referral activity to prevent abuse. Fraudulent behavior includes but is not limited to: creating fake accounts for self-referral, using automated systems, or sharing codes on coupon/deal websites without authorization.

7. Intellectual Property

Platform Ownership

The Service, including all content, features, and functionality, is owned by ScoreUp Pro and protected by intellectual property laws.

Your Content

You retain ownership of content you submit (essays, answers). By submitting, you grant us a license to process your content through AI services for grading and feedback, and to use anonymized data to improve our services.

AI-Generated Content

Feedback and scores generated by our AI are provided for your personal educational use. We retain rights to the underlying algorithms and methodology.

8. Prohibited Uses

You agree not to:

• Violate any applicable laws or these Terms
• Share your account credentials with others
• Use the Service to cheat on official examinations
• Scrape or extract data using automated means
• Attempt to gain unauthorized access to our systems
• Transmit harmful, threatening, or abusive content
• Interfere with or disrupt the Service

10. Third-Party Services

Our Service integrates with: AI providers (OpenAI, Anthropic, Google) for content processing, Stripe for payment processing on the website, Apple (App Store) for purchases in the iOS app, Google and Apple (Sign in with Apple) for authentication, and cloud infrastructure providers. These services are governed by their own terms and privacy policies.

11. Data Privacy and Security

We take your privacy seriously. Our collection and use of your personal information is governed by our Privacy Policy. While we implement industry-standard security measures, no method of transmission is 100% secure.

12. Disclaimers and Limitation of Liability

We provide the Service with reasonable care but do not warrant that it will be uninterrupted, timely, or error-free. Your statutory warranty rights as a consumer remain unaffected.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slightly negligent breach of an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible and on which you may reasonably rely), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

13. Indemnification

You agree to indemnify and hold harmless ScoreUp Pro from claims resulting from your violation of these Terms, your use or misuse of the Service, or your content.

This indemnification obligation applies to business users only. Consumers within the European Union are not required to indemnify ScoreUp Pro under this section, in accordance with applicable consumer protection laws.

14. Termination

By you: you cancel the Unlimited monthly plan as described in Section 4. You can delete your account at any time in your account settings; if a subscription bought on our website is still running, it ends with the deletion, and we do not refund the unused part of the current month. If you want to use the month you have paid for, cancel the subscription and delete your account only after the subscription has ended. An App Store subscription must also be cancelled in the App Store.

By us: we may terminate a free account at any time with two weeks' notice, and a running subscription at the end of any billing month. Both parties' right to terminate for good cause without notice (Section 314 BGB) is unaffected; good cause for us includes in particular fraud, sharing the account with others, or a material breach of these Terms despite a warning. If we terminate for reasons you are not responsible for, we refund amounts already paid for the time after the end of the contract pro rata.

15. Dispute Resolution

Governing Law: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded to you by the mandatory provisions of the country in which you have your habitual residence.

Jurisdiction: If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Frankfurt am Main, Germany. For consumers, the statutory places of jurisdiction apply.

Informal Resolution: If you have a concern, please contact us first at contact@scoreup.pro; we will try to find a solution together with you. This is a request, not a requirement: your rights, in particular your right to go to court, are not affected.

Consumer Dispute Resolution: We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

16. General Provisions

Changes to Terms: We may change these Terms. Changes that only affect future purchases or free use apply from their publication on this page. Changes that affect an existing paid contract apply to it only with your consent; we inform you in advance by email and in the app. Continued use of the service does not count as consent.

Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ScoreUp Pro.

Severability: If any provision is found invalid, the remaining provisions continue in effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
