Welcome to ScoreUp Pro! These Terms of Service ("Terms") govern your use of the ScoreUp Pro platform, available at scoreup.pro (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
By creating an account, accessing, or using ScoreUp Pro, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.
Age Requirements: You must be at least 16 years old to use our Service. If you are between 16 and 18 years old, you confirm that you have obtained parental or guardian consent. Users under 16 must have a parent or guardian create and manage their account.

Our Service provides practice exams for Writing, Reading, and Listening skills, AI-powered grading and feedback, progress tracking, and gamification features including XP and badges.
Important: ScoreUp Pro is a practice tool. We are not affiliated with official IELTS, Goethe-Institut, or PTE examination bodies. AI-generated scores are estimates for practice purposes only.
To use certain features, you must create an account by providing a valid email address, secure password, and your name—or authenticate via Google OAuth. You agree to provide accurate information and keep it current.
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized access.
Individual Accounts: For personal use by individual learners.
Organization Accounts: For schools and teachers who manage student accounts. Organization holders must obtain necessary permissions and comply with educational privacy laws.
All payments are processed securely through Stripe. We do not store your complete credit card information.
Digital Content: By purchasing a subscription or exam pack, you agree to immediate access to our digital services and acknowledge that you waive your right of withdrawal once the service begins.
Cancel anytime through your account settings. You'll retain access until the end of your current billing period. No refunds are provided for partial billing periods.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
You expressly agree that we begin the execution of the contract before the withdrawal period has expired, and you acknowledge that you lose your right of withdrawal with the commencement of the execution of the contract. This consent is obtained during the checkout process via a mandatory checkbox.
ScoreUp Pro offers a referral program that allows existing users to invite friends and earn rewards.
We monitor referral activity to prevent abuse. Fraudulent behavior includes but is not limited to: creating fake accounts for self-referral, using automated systems, or sharing codes on coupon/deal websites without authorization.
Note: We reserve the right to modify, suspend, or terminate the referral program at any time. Fraudulent referral activity may result in forfeiture of rewards and account termination.
The Service, including all content, features, and functionality, is owned by ScoreUp Pro and protected by intellectual property laws.
You retain ownership of content you submit (essays, answers). By submitting, you grant us a license to process your content through AI services for grading and feedback, and to use anonymized data to improve our services.
Feedback and scores generated by our AI are provided for your personal educational use. We retain rights to the underlying algorithms and methodology.

Important Notice: Our Service uses AI from third-party providers (OpenAI and Anthropic) to analyze your submissions.
AI-generated scores and feedback are estimates and may not reflect official examination scoring. They should be used as learning tools, not definitive assessments. We make no guarantees regarding your performance on official examinations.
Our Service integrates with: AI providers (OpenAI, Anthropic) for content processing, Stripe for payment processing, Google for authentication, and cloud infrastructure providers. These services are governed by their own terms and privacy policies.
We take your privacy seriously. Our collection and use of your personal information is governed by our Privacy Policy. While we implement industry-standard security measures, no method of transmission is 100% secure.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will function uninterrupted or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim or €100, whichever is greater.
You agree to indemnify and hold harmless ScoreUp Pro from claims resulting from your violation of these Terms, your use or misuse of the Service, or your content.
This indemnification obligation applies to business users only. Consumers within the European Union are not required to indemnify ScoreUp Pro under this section, in accordance with applicable consumer protection laws.
By You: Delete your account anytime through account settings or by contacting us.
By Us: We may suspend or terminate your account for violation of these Terms, fraudulent activity, or at our discretion. Upon termination, your right to use the Service ceases immediately.
Governing Law: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: For consumers in the EU, mandatory consumer protection laws of your country of residence apply. For business users, the exclusive place of jurisdiction is Frankfurt am Main, Germany.
Informal Resolution: Before filing a claim, contact us at contact@scoreup.pro. We'll attempt to resolve disputes in good faith for at least 30 days.
EU Online Dispute Resolution: The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Changes to Terms: We may modify these Terms at any time. We'll notify you of material changes via email and in-app notice. Continued use constitutes acceptance.
Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ScoreUp Pro.
Severability: If any provision is found invalid, the remaining provisions continue in effect.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
